FABOO General Terms and Conditions
I. Terms of use
1. Scope of application
FABOO AG (‘FABOO’) operates a web shop in cooperation with the regional sales partner, in which business customers can purchase discounted public transport products for certain persons (hereinafter referred to as ‘customer’ or ‘user’, whereby the feminine form also includes the masculine form). FABOO itself does not sell any transport services, but merely provides business customers and users with a web shop where users can purchase public transport products that are (partially) financed by the business customers (e.g. employers or third parties). FABOO is merely the operator of this web shop. These GTC apply to all products and services available via the FABOO webshop.
2. Contracting parties
FABOO does not act as a seller of transport services. The regional sales partner is the selling party. The contract of carriage is concluded directly between the transport companies in partnership with FABOO, which provide the specific transport service, and the Customer.
FABOO maintains a separately regulated contractual relationship with the regional sales partner regarding the use of the web shop.
3. Applicable provisions
For the purchase of tickets via the FABOO web shop and the carriage of passengers, the tariffs of the Swiss transport companies apply, in particular the ‘General Passenger Tariff T600’ and the network tariffs of the Swiss networks as amended from time to time, including the tariff and other provisions set out therein, unless otherwise regulated by these GTC. The relevant fare information can be viewed both at the staffed sales points of the transport companies operating in the network areas and online on the Alliance SwissPass website ‘Overview of fares and regulations’ or on the websites of the respective transport companies and the networks.
4. Means of payment
The user requires a valid electronic means of payment for the purchase of tickets. The user must ensure that the selected means of payment has a sufficient limit for their purchases and is not blocked.
5. Availability of the webshop
There is no entitlement to the availability of the webshop. The lack of functionality of the application does not legitimise the customer to start a journey without a valid ticket. She is obliged to obtain the ticket via one of the other sales channels (ticket counters, ticket machines, etc.) before starting the journey.
6. Liability
FABOO may change the content and offers of the web shop at any time. Any liability of FABOO in connection with the content, functionality and use of the FABOO webshop, including liability for malware, is excluded to the extent permitted by law. If the functionality of the web shop and other related technical processes are impaired and the purchase of an electronic ticket is therefore not possible or restricted for technical reasons, the operator rejects any liability for any resulting damage. In particular, the user is responsible for ensuring the functionality of her terminal device and protecting it against unauthorised access.
II. Tariff provisions
7. Purchase of subscriptions
Before purchasing a public transport product, the FABOO web shop shall inform the user of the purchase price and the amount of the financial contribution from the employer or third parties.
8. Validity of the ticket and price calculation
8.1 Tariff
When calculating the fare, the FABOO web shop only takes into account the scheduled stops within the area of validity.
8.2 Visibility of the fares
The fares can be found in the relevant fare conditions. They are per selected public transport product and in Swiss francs. Value added tax is included in all prices. The price to be paid by the customer (after deduction of the employer's or third party's contribution) will be charged to the customer by the respective financial institution according to the selected payment method. The contract concluded between the financial institution and the client shall be authoritative.
8.3 Misuse or forgery
In the event of misuse or falsification, the provisions of the applicable tariff (of the associations or Swiss transport companies) shall apply. The Operator also reserves the right to block the webshop user account in such cases and to take appropriate legal action.
9. Changes to the tariffs and the GTC
FABOO and the regional sales partners can unilaterally change the applicable tariffs and GTC at any time. Customers will be informed in advance of any changes to the GTC. If the currently valid GTC are not accepted, the webshop cannot be used.
10. Applicable law and place of jurisdiction
Subject to other statutory provisions, the relationship between the operator FABOO and the regional sales partner shall be governed exclusively by Swiss law. The exclusive place of jurisdiction, place of fulfilment and place of debt collection is Zug, unless mandatory provisions stipulate otherwise.
